papershot Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and Wellbayt LLC-FZ ("papershot", "we", "us"), a free zone limited liability company registered in Dubai, United Arab Emirates. By signing in, making a moment, joining one, adding a photo, video or memo, or otherwise using papershot, you accept these Terms. We have kept the language plain; read it anyway.

1. Who May Use papershot

• You must be 13 or older, 16 where the EEA requires it, and 18 where the law where you live requires it. You confirm this, and accept these Terms and the Privacy Policy, at sign-up and at your first join as a guest.
• If you are under the age of digital consent where you live, a parent or legal guardian must accept these Terms for you and supervise your use.
• If you use papershot for an organisation, you confirm that you have authority to bind it to these Terms.

2. Your Account and Guest Access

• Hosting a moment needs an account. You can sign in with Apple or with Google.
• Guests can join a moment without an account. The app gives your install a signed identifier so your shots stay yours; if you sign in later, you can claim the media you added as a guest.
• A "Continue as test user" route exists only for app store reviewers. An operator switches it on, and every tester and administrator action is logged.
• Keep your device and sign-in secure. You are responsible for what happens on your account.
• Tell us at once at papershot@wellbayt.com if you suspect someone else is using your account.
• You can delete your account at any time in Settings under Delete account. Your moments and media go at once; the account row is purged after the 30-day grace period described in the Privacy Policy.

3. Moments, Hosts and Guests

• A moment is a private, time-boxed shared roll. The host makes it, picks the film look, and sets the rules: shots per guest (5, 10, 16, 24, 36 or unlimited), one video per guest of 5 to 30 seconds, and one memo per guest of 5 to 60 seconds. The host can write a prompt for videos and memos (up to 120 characters) and a Guest Lens shot list.
• Guests join from the invite card, by scanning the QR code or opening the link, in the iOS or Android app. Photos, videos and memos are made in the app, not on the web.
• The host decides when the roll develops: as it happens, when the roll closes, or after a delay the host sets. Until then, what other guests add is visible only to the host and the person who added it.
• Hosts control visibility and can remove items and block a guest from posting.
• A free moment keeps media for 48 hours after it closes; a paid moment keeps it for 30 days. After that, a scheduled job deletes the media and the records for good. Guest data lives and dies with the moment.
• papershot is not a backup service. Save what you want to keep.

4. Purchases and Refunds

• A host can unlock a moment with a one-time in-app purchase through Apple or Google. Unlocking raises the guest capacity (8, 24, 48, 72, 120 or unlimited) and keeps the roll for 30 days after it closes.
• Top-ups add 8, 24 or 48 guests to a paid moment and stack.
• The buyer is the host. Guests never pay. There are no subscriptions and nothing renews.
• Prices are shown in the app at the moment of purchase.
• iOS purchases are processed by Apple under the Apple Media Services Terms; Android purchases by Google under the Google Play Terms; web purchases by Stripe.
• Refunds for app purchases go through Apple or Google under their rules. Your rights under mandatory law (for example the 14-day right of withdrawal under the EU Consumer Rights Directive, the UK Consumer Contracts Regulations 2013, or UAE consumer protection rules) are unaffected. If a technical fault on our side stopped a paid moment from working, email papershot@wellbayt.com with the transaction id and we will help.

5. Permissions and Device Access

• Camera access is used only while you are taking a photo or video.
• Microphone access is used only while you are filming a video or leaving a memo.
• Photo library access is used only when you are picking a photo or saving one.
• Push notifications and Live Activities are optional. Manage them in your device settings.
• You are responsible for mobile data and any carrier charges while using papershot.

6. Your Content

Ownership. You own the photos, videos and memos you add, and the Studio exports you make are yours.

Licence to papershot. You grant us a worldwide, non-exclusive, royalty-free licence to store, process, screen, transmit, display to the moment's participants, and deliver your content and moment data, only as needed to run papershot for you and the other participants. We can pass this licence to our subprocessors for the same purpose and to nobody else. It ends when the content is deleted, subject to the retention windows in the Privacy Policy.

Hosts. Hosts control who joins through the invite card, when the roll develops, and what stays on it; a host can remove any item and block a guest from posting. As host, you hold a non-exclusive licence to use the participants' content only to run, view, share and export that moment for personal, event or internal purposes.

Participants. You keep ownership of what you add. You grant the host the limited licence above. Your content is shown to the other participants according to the moment's reveal setting.

You confirm that you hold the rights you need to add your content, that it does not infringe anyone else's rights, and that you have the consent you need from the people in it (especially minors).

We may hide or remove content, or suspend accounts, that break these Terms or the law. Section 8 explains how that works and how to appeal.

7. Acceptable Use

Do not:

• Break the law, violate other people's rights, or add unlawful, infringing, harassing, hateful, pornographic or excessively violent content, or any sexual content involving minors
• Add other people's photos, videos or voices without permission
• Reverse-engineer, interfere with, disrupt or overload the service
• Use bots, scrapers or unauthorised automation against the service, except accessibility tools you use yourself
• Impersonate anyone or misrepresent who you are with
• Use the service where a comprehensive embargo by the United Nations, the European Union, the United States or the United Kingdom forbids it

8. Moderation and Reporting

Zero tolerance. We do not tolerate objectionable content or abusive behaviour on papershot.

• Any participant can report a photo, video or memo from the item itself, choosing a reason: nudity or sexual content, violence or graphic content, harassment or hate, spam, or something else.
• Any participant can block another participant, so that nothing that person adds is shown to them again. Hosts can also block a guest from posting.
• Every finished upload is screened automatically: the thumbnail of a photo or the poster frame of a video is checked by Amazon Rekognition, never the original file and never audio. A high-confidence match hides the item and files a report for a person to review. If the screening cannot run, the item stays visible.
• We review reports within 24 hours. Content that breaks these rules is removed, and the account or install that posted it may be removed from the moment or suspended.
• Statement of reasons. If we hide or remove your content or restrict your account, we tell you what we did and why, where the law requires it and where we can reach you.
• Appeals. To challenge a decision, email papershot@wellbayt.com with "Appeal" in the subject line. A person who did not make the original decision reviews it.

9. Third-Party Services

papershot runs on services from Amazon Web Services, Apple, Google (Firebase Cloud Messaging, Google Play Billing, Google Sign-In and Firebase Analytics), Sentry and Stripe, under their own terms. We are not responsible for third-party websites or materials you reach through the service. See /subprocessors for the current list.

If you send us feedback or suggestions, we may use them without any obligation to you, and you grant us a worldwide, perpetual, irrevocable, royalty-free licence to do so.

10. App Store Terms

Apple. These Terms are between you and papershot, not Apple. Apple has no support obligations. If the service fails to meet an applicable warranty you can notify Apple, and Apple may refund the purchase price. Apple and its subsidiaries are third-party beneficiaries and may enforce these Terms.

Google. These Terms are between you and papershot, not Google. Use on Android must follow Google Play policies. Google is a third-party beneficiary.

Apple's LAEULA. iOS downloads are subject to Apple's Licensed Application End User License Agreement, which controls if there is a conflict on matters specific to the iOS download.

11. Copyright and Trusted-Flagger Notices (DMCA / EU DSA / UK)

Send copyright infringement claims by email to papershot@wellbayt.com with "Copyright" in the subject line, including:

1. Your contact information
2. Identification of the work you say is infringed
3. The specific location of the content on papershot
4. A good-faith statement that the use is not authorised by the rights holder
5. A statement, under penalty of perjury, that the information is accurate and that you are authorised to act for the rights holder
6. Your physical or electronic signature

Repeat infringers may have their accounts terminated.

In the EU. Under Regulation (EU) 2022/2065 (the Digital Services Act), you can send a notice of illegal content to papershot@wellbayt.com with "DSA notice" in the subject line. We give a statement of reasons for any moderation decision affecting your content and tell you how to challenge it.

In the UK. Under the Online Safety Act 2023 you can report illegal content to the same email. We respond as the law requires.

12. Notifications and Live Activities

With your permission, we send push notifications about a moment starting, ending soon or ended, a recap two days later, and deletion warnings. They are rendered on our server in your app language. On iOS, a Live Activity can show the running roll on your lock screen. You can turn both off in your device settings at any time.

13. Disclaimers

The service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. This clause does not limit any non-excludable statutory rights you have as a consumer under EU, UK, Australian, UAE or other local law.

14. Limitation of Liability

To the fullest extent the law permits:

1. papershot is not liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost data or business interruption.
2. Our total liability is capped at the greater of (i) the amounts you paid papershot in the preceding six months, or (ii) USD 100.

These limits apply even if a remedy fails of its essential purpose. They do not limit liability that cannot be limited under applicable law (for example gross negligence, wilful misconduct, fraud, death or personal injury caused by negligence under EU or UK law, or non-excludable consumer-law warranties).

15. Indemnity

You will defend and hold papershot harmless from claims, damages, losses and expenses (including reasonable legal fees) arising from your content, your use of the service, or your breach of these Terms or the law. This clause does not apply to consumers acting outside any trade, business, craft or profession where EU, UK or other local consumer law forbids it.

16. Termination

You can stop using the service at any time. We may suspend or end your access, or remove content, for breaches of these Terms or the law, with notice where reasonably practicable. The sections on intellectual property, disclaimers, liability limits, indemnity and dispute resolution survive termination.

17. Changes to These Terms

We may update these Terms. We give at least 30 days' notice of material changes in the app or by email, unless the law requires a shorter period or we need to address a security issue. Using papershot after the change means you accept the new Terms. If you do not accept them, you can delete your account.

18. Governing Law and Dispute Resolution

Governing law. These Terms are governed by the federal laws of the United Arab Emirates as applied in the Emirate of Dubai, without regard to conflict-of-laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

Consumer carve-out (EEA, UK, Switzerland). If you are a consumer resident in the EEA, the UK or Switzerland, you also benefit from any mandatory provisions of the law of your country of residence. The choice of UAE law does not take those protections away, and you can bring proceedings in the courts where you live.

Consumer carve-out (other jurisdictions). If you are a consumer somewhere else (including Australia, Brazil, Canada or a U.S. state) whose law gives you a non-waivable right to bring proceedings locally, this clause does not waive that right.

Informal resolution. Before filing a claim, email papershot@wellbayt.com with "Dispute" in the subject line. A 30-day resolution window applies.

Courts of Dubai. Subject to the consumer carve-outs above, you and papershot submit to the exclusive jurisdiction of the courts of Dubai, United Arab Emirates, for any dispute arising out of or in connection with these Terms.

EU online dispute resolution. The European Commission's online dispute resolution platform is at ec.europa.eu/consumers/odr.

19. Other Terms

• Export and sanctions. You must follow applicable export, re-export and sanctions laws. Use is prohibited in countries, or by parties, under comprehensive embargo.
• Severability. If a term cannot be enforced, the rest still apply.
• Assignment. We may assign these Terms in a merger, acquisition, financing or sale of assets. You may not assign them without our consent.
• No waiver. If we do not enforce a term, we can still enforce it later.
• Entire agreement. These Terms, the Privacy Policy and any other policies they refer to are the entire agreement between you and papershot about the service.
• Language. The English version of these Terms controls. Translations are for convenience.
